ASSUMPTION OF RISK, RELEASE OF LIABILITY & COMMUNITY GUIDELINES
Ride Together is operated by RideTogether.io, a company incorporated in Hong Kong ("we", "us", "the Company"). Please read this document carefully — by accepting it you give up certain legal rights, to the extent permitted by the law that applies to you.
You must be at least 18 years old and legally able to enter into this agreement. By accepting, you confirm that you are.
Ride Together is a technology platform that helps cyclists find each other. We do not organise, lead, supervise, control, or participate in any ride. We do not vet, screen, or run background checks on users, verify their skill, fitness, equipment, or insurance, or inspect any route. Ride hosts are independent users, not our employees, agents, or representatives. Any ride you join or host is arranged privately between you and other users, at your own initiative and risk.
Cycling — especially group cycling on open roads — carries inherent and significant risks that cannot be eliminated, including: collisions with vehicles, riders, pedestrians, or objects; falls; road, weather, and traffic conditions; mechanical or equipment failure; the conduct, ability, or negligence of other riders and third parties; riding in areas where emergency help may be delayed. These risks can result in serious injury, permanent disability, or death, and in damage to or loss of property. You voluntarily choose to participate with full knowledge of these risks and, to the maximum extent permitted by applicable law, you assume them.
You agree that you will: (a) only join or host rides suited to your genuine fitness and ability, and describe your pace and routes honestly when hosting; (b) be medically fit to ride, and consult a doctor if unsure; (c) use a roadworthy bicycle and wear a helmet and any equipment required by local law (helmets are mandatory in Australia and required for many riders under Thai law); (d) obey all traffic laws and road rules of the place where you ride; (e) not ride under the influence of alcohol or drugs; (f) treat other users with respect — harassment, discrimination, dangerous riding, or dishonest conduct may result in suspension or removal from the platform; (g) carry your own accident, medical, and/or travel insurance appropriate for cycling. We do not provide any insurance and strongly recommend you obtain cover.
The platform does not track your location during a ride and cannot detect an accident or summon help. Features such as emergency contacts depend on your device, network coverage, and other riders, and may fail or be unavailable. They are not a substitute for emergency services. In an emergency, contact local emergency services directly (Thailand: 191 / 1669; Australia: 000; Hong Kong: 999). Emergency contact details you provide are visible only to riders sharing an active ride with you.
To the maximum extent permitted by applicable law, you release and discharge the Company and its officers, directors, employees, and contractors from all liability, claims, and demands arising out of or connected with (a) your participation in any ride found, joined, or hosted through the platform, and (b) the acts or omissions of other users. Nothing in this document excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our own negligence where such exclusion is prohibited, or liability for fraud, gross negligence, or wilful misconduct.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this document excludes, restricts, or modifies those guarantees or any rights you have under them, except as follows: to the extent our services are recreational services (as defined in section 139A of the Competition and Consumer Act 2010 (Cth) and applicable State or Territory legislation), we exclude liability for death or personal injury resulting from a failure to comply with the consumer guarantees — but this exclusion does not apply to significant personal injury caused by our reckless conduct, and it applies only to the extent permitted by law.
Nothing in this document excludes or restricts any liability that cannot lawfully be excluded or restricted under Thai law, including the Unfair Contract Terms Act B.E. 2540 and the Civil and Commercial Code. Each limitation in this document applies only to the extent it is fair and reasonable and enforceable under Thai law.
Nothing in this document excludes or restricts our liability for death or personal injury resulting from our negligence, or any other liability that cannot be excluded under the Control of Exemption Clauses Ordinance (Cap. 71).
To the extent permitted by applicable law, you agree to indemnify the Company against claims brought by third parties (including other users) arising from your breach of this document, your violation of law, or your negligent or wilful acts while participating in a ride.
If any part of this document is found unenforceable, the rest remains in effect, and the unenforceable part applies to the greatest extent permitted. This document is governed by the laws of Hong Kong, without limiting any non-waivable consumer protections you have in the country where you live. We may update this document; material changes will require your renewed acceptance.
